RESOLUTION NO. R-2012-132 RESOLUTION AUTHORIZING CHANGE ORDER NO. 1, ENTLER EXCAVATING COMPANY, INC. 2011 MISC. STORM AND SANITARY SEWER IMPROVEMENT PROJECT CITY PROJECT 2011-09 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the Contract between Entler Excavating Company, Inc., and the City of Decatur be, and the same is hereby, modified and amended to authorize Change Order No. 1 for a time extension of 98 days; and a completion date of September 7, 2012; and no change to the not-to-exceed project cost of$482,210. Section 2. That the Mayor and City Clerk be, and they are hereby, authorized and directed to execute said Change Order No. 1, on behalf of the City of Decatur. Section 3. That the changes in the above-described Contract are germane to said Contract, as signed, and such Change Orders are in the best interest of the City of Decatur and are authorized by law. Section 4. That the Public Works Director hereby certifies that the additional work was not foreseeable at the time said Contract was bid and let. PRESENTED and ADOPTED this 18th day of June, 2012. MICHAEL T.
