Marley, P.E., Public Works Director <br /> SUBJECT: Stipulated Agreement 1647 Between the Illinois Commerce Commission, <br /> Norfolk Southern Railway Company, City of Decatur and the Illinois <br /> Department of Transportation for the Improvement of the Highway-Rail Grade <br /> Crossing on Faries Parkway approximately 3,400 Feet East of Brush College <br /> Road <br /> City Project 2012-05 <br /> SUMMARY RECOMMENDATION: <br /> It is recommended that the City Council approve the attached Resolutions authorizing the Mayor to <br /> sign and the City Clerk to attest to the following items: <br /> 1. A Resolution authorizing an agreement between the Illinois Commerce Commission (ICC), <br /> Norfolk Southern Railway Company, the City of Decatur and the Illinois Department of <br /> Transportation (IDOT) for the improvement of the highway-rail grade crossing on Faries <br /> Parkway located approximately 3,400 feet east of Brush College Road. <br /> The City's portion of the costs for the highway-rail grade crossing improvement is $21,930. <br /> The City is also required to install and maintain advance warning pavement markings for the <br /> crossing. <br /> 2. A Resolution appropriating $21,930 in Motor Fuel Tax(MFT) funds to pay for the City's <br /> portion of the crossing improvement. <br /> PRIOR COUNCIL ACTION: <br /> There have been no prior Council actions on this improvement. <br /> BACKGROUND: <br /> The Illinois Commerce Commission has evaluated the highway-rail grade crossing on Faries <br /> Parkway, east of Brush College Road and has recommended safety improvements to the crossing. <br /> The proposed improvements include the installation of flashing lights and gates along with the <br /> installation of advance warning pavement markings. See the attached location map. <br /> The total estimated cost for the improvement is $219,304 which is divided between the Grade <br /> Crossing Protection Fund ($186,409),the Norfolk Southern Railway Company($10,965) and the <br /> City($21,930). If costs exceed the total estimated amount, the additional costs will be distributed <br /> among the participants. <br /> Page 1 <br />
