Excerpts from Plan Commission Minutes of July 9,2015:
Cal. No. 15-22 Petition NEW DAY COMMUNITY CHURCH, to
rezone property located in the 4100 BLOCK of
NOTTINGHAM DRIVE from R-3 Single Family
Residence District to R-6 Multiple Family
Residence District.
Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland.
The subject site is located in the 4100 Block of Nottingham Drive and is currently zoned R-3
Single Family Residence District and consists of approximately 22.7 acres.
The petitioner proposes to rezone from R-3 Single Family Residence District to R-6 Multiple
Dwelling District to allow for all those uses permitted in the R-6 Multiple Dwelling District.
Rezoning the site from R-3 Single Family Residence District to R-6 Multiple Dwelling District
should not create any adverse effects on the adjacent properties or the City as a whole.
The surrounding zoning includes County to the north, County and R-1 Single Family Residence
District to the east, R-3 Single Family Residence District to the west and R-1 Single Family
Residence District to the south. The Macon County and Decatur Comprehensive Plan shows this
area as a mixture of uses including Open Space, Mixed-Use Commercial/Residential,
Institutional, Schools — Public & Private and Residential — Low Density. The permitted uses in
the R-6 District are compatible with both the existing adjacent uses and zoning districts.
Staff recommends approval of the rezoning.
Section XXIX. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a
public hearing on a rezoning request, and then forward its report and recommendation to the City
Council for final approval. A motion to forward Calendar Number 15-22 to the City Council
with a recommendation for approval is suggested.
Mr. Kent Newton stated the letter in the packet spoke about R-5 Two-Family Residence District
and the request is for R-6 Multiple Family Residence District. He asked if this was a typo. Mrs.
Stewart said the petitioner changed his mind.
Mr. Bruce Jacobs, petitioner, was sworn in by Mrs. Poland.
Mr. Jacobs said the property was purchased eleven (11) years ago and a church was built on the
county portion of the property. They would like to build a duplex so that he is able to work and
care for his wife who has a neurological disorder. He plans to have his parents move into the
other side of the duplex so he and his mother will be able to care for his wife and his father. His
plans are to build another duplex which would eventually house a caretaker and possibly other
family members who have the same neurological disorder. Sometime in the future they might
possibly build another duplex or triplex to help other family or church members to care for their
family and to keep them out of a nursing home.
There were no questions or no objectors present.
It was moved and seconded (Dial/Myatt) to forward Calendar No. 15-22 to the City Council with
a recommendation for approval. Motion carried unanimously.
