Y <br /> AGREEMENT <br /> This Agreement is made and entered into by and between the City of Decatur, Illinois, a <br /> municipal corporation hereinafter referred to as the "City", and A-1 Taxi, a sole proprietorship <br /> company, authorized to do and doing business in the City of Decatur as a taxi company, and <br /> hereinafter referred to as the "Taxi Company". <br /> WHEREAS, as a recipient of U.S. Department of Transportation, Federal Transit Administration <br /> (FTA) funding assistance, and as required by FTA regulations, the City provides complementary <br /> paratransit service for people with disabilities who are unable to use the City's fixed-route bus <br /> system, through vehicles owned and operated by the City, and through user-side subsidies to <br /> disabled passengers who choose to use the services of licensed, private vendors. The City's <br /> complementary paratransit service is hereinafter referred to as"Operation Uplift"; and <br /> WHEREAS the Taxi Company is duly licensed by the City as an operator of taxicabs; and <br /> WHEREAS the Taxi Company is willing and able to accept the responsibilities, obligations and <br /> terms of this Agreement; and <br /> WHEREAS the Taxi Company understands and acknowledges that this Agreement does not <br /> grant exclusive rights to the Taxi Company, and that the City reserves the right to enter into a <br /> similar agreement with one or more private vendors. <br /> NOW THEREFORE, for and in consideration of the promises, covenants, agreements and <br /> conditions hereinafter set forth to be performed,kept and met by the respective parties hereto, <br /> this Agreement is made by and between the City of Decatur, Illinois, and A-1 Taxi as follows: <br /> PURPOSE AND SCOPE <br /> The purpose of this Agreement is to facilitate the City's complementary paratransit service for <br /> people with disabilities who are unable to use the City's fixed-route bus system, and who choose <br /> to use the transportation services of licensed,private vendors,by establishing a streamlined <br /> method of fare subsidy reimbursements. This Agreement is not intended to establish the <br /> framework for the City's purchase of transportation services from the Taxi Company; this <br /> Agreement is intended to establish the most cost effective method of paying user-side fare <br /> subsidies to people with disabilities who choose to use the paratransit services of licensed, <br /> private vendors. Through this Agreement the City will pay fare subsidies directly to the Taxi <br /> Company for all eligible rides provided by the Taxi Company, in lieu of fare subsidy <br /> reimbursements to each individual Operation Uplift rider for each eligible ride. <br /> - 1 - <br />
