13. Failure to comply with these operational requirements, or refusal to permit the City to monitor the Taxi Company's compliance, shall be grounds for immediate suspension or termination of this Agreement. FEDERAL REPORTING REQUIREMENTS As required by the U.S. Department of Transportation, Federal Transit Administration(FTA), the Taxi Company shall report information to the City to be included in the National Transit Database. Information to be reported shall include,but not be limited to, the following: 1. The Taxi Company shall report monthly on any incident or accident involving a taxi vehicle, providing Operation Uplift service at the time of the incident or accident, that results in: • Vehicle evacuation for life safety reasons; or • Property damage totaling at least$25,000; or • One or more injuries requiring immediate medical care away from the accident site; or • One or more fatalities. 2. The Taxi Company shall report monthly the number of vehicles used to meet the maximum service requirement for Operation Uplift during the month. 3. The Taxi Company shall report annually, for the period from July 1St through June 30th, on how operating revenues from Operation Uplift were spent by the taxi company, reporting the percentages (not dollar amounts)broken down into four categories: • Driver and dispatcher wages and benefits; • Vehicle maintenance; • Facility maintenance; and • General administration. 4. The Taxi Company shall report annually on the number and categories of vehicles, as of June 30th: • The total number of vehicles (including inactive and unusable vehicles) available for taxi service; • The number of active, usable vehicles available for taxi service; and • The number of active, usable vehicles that have wheelchair lifts or ramps. OBLIGATIONS OF THE CITY The City shall act to facilitate Operation Uplift for the benefit of the Operation Uplift partic- ipants and the Taxi Company, and hereby accepts the following obligations: 1. The City shall have the responsibility for establishing, and the City reserves the right to amend, the guidelines and requirements of Operation Uplift, including the service area and the hours of operation, at any time. - 6 -
