Section L. LICENSES AND PERMITS 1. It shall be the responsibility of Layne Christensen to obtain any and all licenses and permits required to conduct the work set forth in this Agreement. Section M.PREVAILING WAGE RATE 1. The general prevailing rates of wages for the locality shall be paid for each craft or type of worker or mechanic needed to execute this Agreement or perform such work as stated in the Illinois Prevailing Wage Act (820 ILCS 130/1 et. seg.) and Layne Christensen agrees to comply with said Act as well as comply with the Prevailing Wage Act Policy of the City, attached hereto, marked Exhibit B and incorporated herein by reference. Section N. FEDERAL LAWS 1. Layne Christensen agrees to comply and to require compliance by any and all of its sub-contractors of any and all applicable federal laws and regulations, including but not limited to the Davis-Bacon Act, the Contract Work Hours, the Safety Standards Act, and the Copeland Anti-Kickback Act, and shall maintain documentation which demonstrates compliance with such. Such documentation shall be made available to the City for review upon request by the City. Section O. EQUAL EMPLOYMENT OPPORTUNITIES 1. Layne Christensen agrees to comply and to require any and all of its sub-contractors to comply with the provisions of the Illinois Human Rights Act or the Rules and Regulations of the Illinois Department of Human Rights ("Department"), the provisions of the Human Relations Code of the City of Decatur and Equal Employment provisions set forth in the notice attached hereto, marked Exhibit C and incorporated herein by reference. Section P. SEVERABILITY 1. If any section, term or provision of this Agreement or the application thereof shall be found or held to be invalid or unenforceable, the remainder of such section, term or provision of the Agreement other than those to which it is held invalid or unenforceable shall not be affected thereby. Section Q. NOTICE 1. All notices, demands, requests, consents, approvals or other instruments required or permitted by this Agreement shall be in writing and shall be executed by the party, officer, agent or attorney of the party, and shall be deemed to have been effective as of the date of actual delivery, if delivered personally, or as of the third (3rd) day from and including the date of posting, if mailed by registered or certified mail, return receipt requested, with postage prepaid, addressed as follows (or to such other address as is provided by notice): 4
