PUBLIC WORKS DEPARTMENT <br /> MEMORANDUM <br /> Date: January 27, 2012 <br /> To: Ryan P. McCrady, City Manager <br /> From: Richard G. Marley, Public Works Director <br /> RE: Baltimore Avenue Water Main at Big Creek <br /> Problem Description: A 12" water main on the West side of Baltimore Avenue at the Big <br /> Creek crossing has a significant leak. The main is a major connection to Mt. Zion and is in <br /> need of immediate repair. <br /> Legal Basis for Emergency Action: This event requires immediate action to suppress or <br /> prevent the spread of disease or to remove imminent danger to persons or property. <br /> Under the definition contained in Chapter 46, Section 1 of the Decatur Municipal Code, this <br /> event is an emergency. <br /> Pursuant to Chapter 46, Section 2 of the Decatur Municipal Code, the City Manager may <br /> declare an emergency based on the facts of the event. Under the emergency powers <br /> granted, the City Manager may utilize all available resources of the City as are necessary <br /> to cope with the emergency including the purchase of repair services that may exceed <br /> $5,000. <br /> Based on the facts of the situation, it is my opinion that an emergency exists and that the <br /> City Manager should declare an emergency so that repairs can be made to the water main <br /> by contract with a private contractor. Based on the nature of the repair, cost of the work is <br /> expected to exceed $5,000. 1 also recommend that Barr Robison Inc. or another qualified <br /> contractor be hired to perform the repair work. <br /> Emergency Declaration: Based on the facts of the event described in this memorandum <br /> and under the authority granted by Chapter 46 of the Decatur Municipal Code, I hereby <br /> declare this event to be a public water supply emergency and authorize the Public Works <br /> Director to purchase repair services to correct problem. <br /> Approved: / 7�Z-- <br /> Ryan McCrady, City M ager Date <br /> Cc: City Clerk <br />
