ORDINANCE NO.2012- 9 3 <br /> AN ORDINANCE AMENDING THE DECATUR MACON COUNTY ENTERPRISE ZONE <br /> -TERMINATION DATE- <br /> -TAX ABATEMENT- <br /> WHEREAS, the City of Decatur filed an application for certification of an enterprise zone with <br /> the Department of Commerce and Community Affairs under the provision of the "Illinois Enterprise <br /> Zone Act" (20 ILCS 655/1 et.seq.)and was certified effective July 1, 1983;and, <br /> WHEREAS, the Department of Commerce and Economic Opportunity, the successor agency to <br /> the Department of Commerce and Community Affairs, extended the certification of the Decatur Macon <br /> County Enterprise Zone effective July 1, 2003 for ten years ending June 30, 2013 under the provisions of <br /> the "Illinois Enterprise Zone Act"(201LCS 655/1 et.seq.)as amended;and, <br /> WHEREAS, the City of Decatur has amended prior Enterprise Zone designating and tax <br /> abatement ordinances including Ordinance 82-122 and Ordinance 92-87 by the passage of amending <br /> Ordinance 2003-33 on June 16,2003, and, <br /> WHEREAS,the Illinois General Assembly unanimously passed Senate Bill 3616 as amended on May <br /> 31,2012;and, <br /> WHEREAS,the Governor signed the bill into law on August 7, 2012,thereby amending the 'Illinois <br /> Enterprise Zone Act" (20 ILCS 655/1 et.seq.) under the provisions of Public Act 97-0905,to automatically <br /> extend the certification of the Decatur Macon County Enterprise Zone through December 31, 2016, and <br /> subject to applications yet to be submitted,through December 31, 2041;and, <br /> WHEREAS, enterprise zones provide state and local incentives in order to promote the <br /> economic growth of the area, to reduce unemployment, and to encourage expansion, rehabilitation, <br /> and new construction of structures within the Enterprise Zone;and, <br /> WHEREAS, the City of Decatur, by and through its designated Enterprise Zone <br /> Administrator, now finds it necessary and desirable to further amend the terms of the Ordinance, as <br /> heretofore supplemented and amended, pursuant to Section 5.4 of the Act. <br />
