1600 Block of West Pershing Road
November 1, 2012
8. A forty (40) foot Right-of-Way will be required to access the two (2) parcels to the west. This
ROW will begin at the Western ROW line of North Norwood Avenue and proceed West along the
petitioner's southernmost property line and then turning North going along the petitioner's
westernmost property line terminating at the Smith property.
9. A twenty (20) foot easement will be required to be centered over the top of the Sanitary District of
Decatur sewer interceptor.
I O.The formal vacation of this ROW does not appear that it will have an adverse affect on the general
public.
11.The right-of-way is not necessary to serve the general public. Staff is of the opinion that the best
interests of the City of Decatur would be served by approving the right-of-way vacation.
STAFF RECOMMENDATION
1. Staff recommends approval of the Right-of-Way vacation with the following conditions:
a. A forty (40) foot Right-of-Way will be required to access the two (2) parcels to the west.
This ROW will begin at the Western ROW line of Norwood Avenue and proceed West
along the petitioner's southernmost property line and then turning North going along the
petitioner's westernmost property line terminating at the Smith property.
b. A twenty (20) foot easement will be required to be centered over the top of the Sanitary
District of Decatur sewer interceptor.
c. A plat must be recorded prior to a vacation ordinance being recorded.
PLAN COMMISSION ACTION
1. The Administrative Policy of the City of Decatur requires that property vacation requests be
submitted to the Plan Commission for a public hearing. Although a Plan Commission
recommendation is not required, a motion to forward the vacation request of Calendar Number 12-
30 to the City Council with a recommendation for approval is suggested.
The above report constitutes the testimony and recommendation of the Planning and Sustainability
Division, Department of Planning and Building Services, City of Decatur.
Suzan M.
