Excerpts from Plan Commission Minutes of November 1,2012 continued:
a. A forty (40) foot Right-of-Way will be required to access the two (2) parcels to the
west. This ROW will begin at the Western ROW line of North Norwood Avenue and
proceed west along the petitioner's southernmost property line and then turning north
going along the petitioner's westernmost property line terminating at the Smith
property.
b. A twenty (20) foot easement will be required to be centered over the top of the
Sanitary District of Decatur sewer interceptor.
c. A plat must be recorded prior to a vacation ordinance being recorded.
The Administrative Policy of the City of Decatur requires that property vacation requests be
submitted to the Plan Commission for a public hearing. Although a Plan Commission
recommendation is not required, a motion to forward the vacation request of Calendar Number
12-30 to the City Council with a recommendation for approval is suggested.
Mr. Steve John asked if requiring the right-of-ways to the west would allow the Park District to
potentially extend access to their bike path in the future. Ms. Stickle said that was correct, it
makes it a public access.
Mr. John stated he would like to see consideration being given to pedestrians and bicycles in
staff reports concerning the vacation of right-of-ways.
Mr. Joseph Banning, petitioner, was sworn in by Mrs. Poland.
Mr. Banning stated he thinks this land swap will be beneficial to him and the public. He would
welcome a connection on this property to the Decatur Park District's bike path. Mr. Banning
said the reason he is here is to enhance his investment and for possible resale of the property in
the future.
There were no questions and no objectors present.
It was moved and seconded (John/Frantz) to forward Calendar No. 12-30 to the City Council
with recommendation for approval as submitted. Motion carried unanimously.
