Excerpts from Plan Commission minutes of October 4,2012 continued:
One (1) reader board pylon style sign is shown on the site plan and shall be located ten (10) feet from all
property lines. Signage shall be in accordance with the regulations for the B-2 District.
The PD plan has been reviewed and approved by the City's Technical Review Committee, Planning,
Engineering and Fire.
Based on the analysis, staff recommends approval of the PD Planned Development Plan with the following
conditions:
a. Final site, landscaping and lighting plans shall be submitted to and approved by the Department of
Planning and Building Services, Public Works Department and the Fire Department prior to
building permits being released.
b. A Subdivision Final Plat must be submitted to and approved by the Department of Planning and
Building Services, Public Works Department and the Fire Department prior to building permits
being released.
c. The Easement that is currently running underneath the building must be vacated prior to site plan
approval.
d. Alcohol sales of any kind are prohibited at this development.
e. Hours of operation will be limited to the hours of 5:00 a.m. to 11:00 p.m.
f. Square footage of the proposed uses shall not exceed the following: Convenience Store 4,880
square feet; Retail 3,055 square feet; Sandwich Shop/Restaurant 1,625 and Coin Laundromat 2,640
square feet.
g. The proposed development will be developed in accordance with an overall design plan approved
by the City of Decatur.
Section XIX.G.2. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a public
hearing to review the Planned Development plan and report its findings concerning the effect on the
comprehensive plan and compliance with the standards of review to the City Council. A motion to forward
Calendar Number 12-37 to the City Council with a recommendation for approval is suggested.
Mr. Phil Cochran, representative, was sworn in by Mrs. Poland.
Mr. Cochran stated the site is located on the northeast corner of North Water Street and East Grand
Avenue. The existing zoning is B-2 and 0-1. Approximately the west two-thirds of the property is zoned
B-2 and the east one-third is zoned 0-1. This is a mixed-use type development and staff felt that a PD
Planned Development District was the proper zoning.
Mr. Cochran said there will be a gas station/convenience store with a sandwich shop which will be
designed with open access as well as shared bathroom facilities. A Laundromat and retail space is also
included in the proposed retail shopping strip.
Mr. Cochran stated the gas station/convenience store is the anchor and based upon a market analysis will
generate $6.3 million in gas sales and $1.6 million in retail merchandise sales. $135,000 will be paid in
real estate taxes for this development.
Mr. Cochran said that Walgreens, which is directly west of the proposed development, is only open until
midnight. They do not sell liquor as the company pulled all their liquor sales out of the City of Decatur.
Mr. Cochran said staff has recommended that liquor not be sold at the convenience store and the hours of
operation should be limited. Mr. Cochran stated his client objects to these recommendations. A
convenience store should be a stop for convenience foods and most of the convenience stores in our area
sell liquor. People will not stop if they have to make an additional stop for liquor. There will only be
package liquor in the store.
