Hook : 4263 Page : 336 ORDINANCE NO. 2012-79 AN ORDINANCE ANNEXING TERRITORY -3130 SOUTH FRANKLIN STREET ROAD - WHEREAS, there having been filed with the City Clerk, and by said Clerk presented to the Council herewith, the petition under oath of James and Linda Miller requesting that there be annexed to the City territory described as: The North 262.02 feet of the South 526.02 feet of the West 166.25 feet of the North %2 of the South 1/2 of the Northwest 1/4 of Section 35, Township 16 North, Range 2 East of the 3`d Principal Meridian, except the North 5 feet thereof, all being in the County of Macon, Illinois. WHEREAS, it appears said petition is signed by the owners of record of all land within such territory and that no electors reside therein, and that said territory is contiguous to the City and not within the corporate limits of any city, village or incorporated town or other municipality; and, WHEREAS,notice of intention to take action for annexation has been given as required. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the petition and the request thereof be, and the same are hereby, approved. Section 2. That upon compliance with the conditions set forth below said above described premises be, and they are hereby annexed to the City territory: a. Said owners must arrange for and pay any and all costs associated with removing the dead tree, grinding down the stump, filling the resulting hole with dirt and restoring the surface contour, said tree generally being on the right of way line of South Franklin Street Rd. and north of the owner's driveway. Section 3. That said territory hereinabove described, along with all parts of public highways therein or next and adjacent thereto not heretofore annexed, if any, be, and the same are hereby, annexed to and are incorporated into the limits of the City of Decatur, Illinois, a municipal corporation.
