PUBLIC WORKS MEMORANDUM <br /> NO. 2012 - 63 <br /> DATE: August 2, 2012 <br /> TO: Honorable Mayor McElroy and City Council Members <br /> FROM: Ryan P. McCrady, City Manager <br /> Richard G. Marley, Public Works Director <br /> SUBJECT: Amendments to Municipal Code, Chapter 29: Administrative Adjudication of <br /> Offenses <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the amendments to the City of <br /> Decatur Municipal Code, Chapter 29 as shown in Exhibit A, attached. <br /> BACKGROUND: On July 30, 2012, Council approved amendments to City Code Chapter 41, <br /> "Miscellaneous Street Regulations" addressing several changes that must be reflected in Table 29-1. <br /> The proposed changes are summarized as follows: <br /> 1. The previous version of Section 3 prohibited trains from blocking street crossings. Since the <br /> City has no authority to regulate railroad operations, this section served no purpose and was <br /> removed. Section 3 was replaced with new language requiring a permit for the placement of <br /> advertising distribution devices on streets, sidewalks, parkways and other public places. <br /> The title of Section 3 was changed to "Advertising Distribution Device Permit Required" and <br /> must be added to Table 29-1. <br /> 2. The previous version of Section 9 was entitled "Obstructing Streets." The revised Section 9 <br /> was renamed "Placing Materials on Public Streets." The section more clearly defined <br /> materials that may not be placed on streets and defined exceptions. The revised title of <br /> Section 9 must be added to Table 29-1. <br /> No other changes to Chapter 29,"Administrative Adjudication of Offenses" are necessary. <br /> BUDGET AND STAFFING IMPLICATIONS: <br /> Budget Impact: There is no perceived budget impact. <br /> Staffing Impact: There is no perceived staffing impact. <br /> POTENTIAL OBJECTION: There are no known objections to the proposed revisions. <br /> INPUT FROM OTHER SOURCES: No input from other sources was not sought as the changes <br /> are administrative in nature. <br /> STAFF REFERENCE: Richard Marley, Public Works Director will be in attendance at the City <br /> Council meeting to answer any questions of the Council on this item. <br /> Attach: 3 <br />
