Section Three Continued Pur ose I Please state the purpose o the proposed rezoning, To allow the future development of industrial facilities and utility infrastructure associated with the ADM Agricultural Processing and Biofuels Production Facility in Decatur, Illinois. SECTION FOUR: JUSTIFICATION The petitioner submits to the City Plan Commission and City Council the ollowin acts addit lonal pages may be attached): Archer Daniels Midland Company purchased property known as Faries Park as part of an agreement to purchase approximately 298 acres from the Decatur Park District. ADM petitions that approximately 155 acres within Faries Park identified by the parcel numbers: 04-13-05-200-006, 04-13-05-400-010, and 18-08-33-353-002 be rezoned to classification M-2. ADM purchased the property to allow the future expansion of the ADM Decatur, IL facility. The agreement between ADM and the Decatur Park District dated November 5, 2003 and the warranty deed dated April 20, 2004 are attached to this petition. The property (04-13-05-200-007, 04-13-05-400-008)west and adjacent to the tracts being petitioned is zoned M-2. The property (04-13-05-200-001, 18-08-32-451-016) northwest and adjacent to the tracts being petitioned is zoned M-2. The tract with the parcel number 14-13-04-100-017 will remain zoned R-1. Figure 1 identifies the parcels being petitioned for rezoning by shading them blue. SECTION FIVE: CERTIFICATION To be placed on the agenda of the regular meeting on the first Thursday of the month at 3:00 PM in the City Council Chambers, petition must be received on the first Thursday of the preceding month. Failure of the petitioner or the petitioner's representative to attend the Plan Commission hearing may result in items being tabled. Signature of this petition grants permission to City staff to place a sign,indicating a request for zoning action,on the subject property at least 10 days prior to the Decatur City Plan Commission hearing. Said sign will be removed within 15 days of final action by City Council. 3. In the event a petition for rezoning is denied by the Council,another petition for a change to the same district shall not be filed within a period of one year from the date of denial, except upon the initiation of the City Council or the City.Plan Commission after showing a change of circumstances which would warrant a renewal. 4.
