r
DEVELOPMENT SERVICES MEMORANDUM
No. 12-40
August 15, 2012
TO: Honorable Mayor Michael T. McElroy and City Council
FROM: Ryan P. McCrady, City Manager
Billy Tyus, Assistant City Manager
Suzan M. Stickle, Senior Planner
Joselyn A. Stewart,Transportation Planner
SUBJECT: Rezoning from R-1 Single Family Residence District to M-2 Heavy Industrial District
located at the 4000 Block of Gun Club Road and the 3000 Block of Christmas Tree Road
SUMMARY RECOMMENDATION: Staff recommends approval of the rezoning to M-2 Heavy
Industrial District. At the regular meeting of the Plan Commission held August 2, 2012, a motion was
made to forward the revised petition to the City Council with a recommendation for approval. Two
members abstained, three members voted in the affirmative, and two voted against. On requests for
rezoning, the Plan Commission is to hold a public hearing and make its report to the City Council. The
minutes of the meeting, attached, and this Summary Recommendation, comprise the Commission's report
to the City Council. The minutes of the July 5, 2012 regular meeting of the Plan Commission are also
attached.
BACKGROUND: On July 5, 2012 this item was heard and tabled by the Decatur Plan Commission in
order for the petitioner to address some of the questions and concerns raised by neighbors. The petitioner
met with neighboring residents and, based on that meeting, reduced the size of the area proposed to be
rezoned, eliminating the area near homes owned by the objectors. Maps showing both the area which
would be rezoned with this petition and the original, larger area are included in the packet.
Several residents that live in the area continue to express objection to the new proposal.
The revised petition's subject site is approximately 154 acres and is located in the 4000 Block of Gun
Club Road and the 3000 Block of Christmas Tree Road. The site was formerly known as Faries Park.
The petitioner proposes to rezone from R-1 Single Family Residence District to M-2 Heavy Industrial
District. ADM purchased the property to allow for the future expansion and development of industrial
facilities and utility infrastructure associated with the agriculture process and biofuels production at the
ADM Decatur, Illinois facility.
POTENTIAL OBJECTION: There were several objectors at both Plan Commission Meetings.
INPUT FROM OTHER SOURCES: The rezoning has been reviewed by the City's Technical Review
Committee; Planning, Engineering and Fire have approved the rezoning.
STAFF REFERENCE: Any additional questions may be forwarded to Joselyn A. Stewart at 424-2782
or at jstewart(re decaturil.gnv_.
BUDGET/TIME IMPLICATIONS: None.
