PUBLIC WORKS MEMORANDUM NO. 2012 - 62 DATE: August 2, 2012 TO: Honorable Mayor McElroy and City Council Members FROM: Ryan P. McCrady, City Manager Richard G. Marley, Public Works Director SUBJECT: Amendments to Municipal Code, Chapter 34: Traffic and Parking. SUMMARY RECOMMENDATION: Staff recommends approval of the amendments to the City of Decatur Municipal Code, Chapter 34, as proposed. BACKGROUND: The proposed amendment to Decatur City Code, Chapter 34, Traffic and Parking, makes the following described changes as shown in Exhibit A, attached: 1. City Council recently approved an ordinance prohibiting vehicles with more than six wheels from using Main, Water and Franklin Streets from Wood to Eldorado Streets. The proposed amendment to Chapter 34, Traffic and Parking, adds the ordinance language to Section 21 and re-titles that section "Over-Sized Vehicle Regulations—Central Business District and Night Parking" 2. Section 73, entitled "Settlement of Fines"was edited to include fines from several sections of the previously approved code that were inadvertently omitted from the settlement of fines table. The fine table was also edited to include the fine for violating Section 21 which prohibits vehicles over 6 wheels from using certain downtown streets. 3. A review of Chapter 34 identified several minor language changes that have been edited for clarity. BUDGET AND STAFFING IMPLICATIONS: Budget Impact: No significant budget impacts have been identified. Staffing Impact: Adding language to the City Code prohibiting vehicles over 6 wheels from certain downtown streets should assist in enforcement of the regulations. No other staffing impacts are identified. POTENTIAL OBJECTION: None INPUT FROM OTHER SOURCES: None STAFF REFERENCE: Richard Marley, Public Works Director will be in attendance at the City Council meeting to answer any questions of the Council on this item.
