Excerpts from Plan Commission Minutes of July 5,2012:
Cal. No. 12-22 Petition of HEARTLAND COMMUNITY CHURCH,to
amend the PD Planned Development located at 3253
NORTH BRUSH COLLEGE ROAD for signage.
Mrs. Stewart presented the recommendation of staff:
On February 3, 2005 the City Plan Commission approved the rezoning from R-1 Single Family
Residence District and M-1 Intense Commercial-Light Industrial District to PD Planned Development
District. The petition was approved by City Council on February 21, 2005.
The petitioner proposed to rezone to PD Planned Development to allow for the construction of an old
west themed town and park. The development was proposed to include various structures (i.e. retail
shops, theater, lodge, petting zoo and office) as well as parking lots to serve the site. The petitioner
proposed four phases for this project. The plans submitted to the City showed details for Phase I only;
subsequent phases were intended to be submitted as amendments to the Planned Development and
were to be heard by the Plan Commission and City Council before any construction would occur. The
Planned Development would require an amendment should the petitioner wish to construct additional
signage that was not reflected in the approved Planned Development site plan.
Currently the petitioner is in violation of their approved PD by having a portable sign on their site
along with their existing permanent sign.
The petitioner proposes to amend their PD in order to add an electronic message unit (EMU). The new
sign cabinets shall not exceed 80 square feet in total size. The total sign area shall not exceed 75
square feet with the EMU portion of the sign not exceeding 37 square feet in area. The sign shall not
exceed eleven (11) feet one and one-half(1.5) inches in height. The existing signage shall be removed
before the new proposed signage is installed.
The PD amendment is consistent with the intent of the originally approved PD.
The PD amendment has been reviewed and approved by the City's Technical Review Committee,
Planning, Engineering and Fire.
Staff recommends approval of the Amendment to PD Planned Development District with the following
condition: All portable and temporary signage be removed prior to building permits being released.
Section XIX.G.2. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a
public hearing to review the Planned Development plan and report its findings concerning the effect on
the comprehensive plan and compliance with the standards of review to the City Council. A motion to
forward Calendar Number 12-22 to the City Council with a recommendation for approval is suggested.
Mr. Aaron McIntosh, representative, was sworn in by Mrs. Poland.
Mr. McIntosh stated he personally designed the sign for the church in effort to help improve the
aesthetics of the property.
There were no questions and no objectors.
It was moved and seconded (Myatt/Livingston) to forward Cal. No. 12-22 to the City Council with
recommendation for approval as presented by staff. Motion carried unanimously.
