ORDINANCE NO. 2012-45 AN ORDINANCE PROHIBITING VEHICLES WITH MORE THAN SIX WHEELS ON - FRANKLIN STREET BETWEEN WOOD STREET AND ELDORADO STREET - -WATER STREET BETWEEN WOOD STREET AND ELDORADO STREET - -MAIN STREET BETWEEN WOOD STREET AND ELDORADO STREET - WHEREAS, The City of Decatur is granted authority under 625 ILCS 5/15-316 to establish ordinances prohibiting the operation of trucks or other commercial vehicles on highways under their jurisdiction; and, WHEREAS, Franklin Street, Water Street and Main Street between Wood Street and Eldorado Street are under the jurisdiction of the City of Decatur; and, WHEREAS, the allowance of through vehicles with more than six wheels on certain downtown streets has raised safety and quality of life concerns. NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That when appropriate signs or markings are installed giving notice thereof, all vehicles having more than six wheels, including vehicles pulling trailers, are prohibited and excluded from the use of the following streets: Franklin Street between Wood Street and Eldorado Street Water Street between Wood Street and Eldorado Street Main Street between Wood Street and Eldorado Street Section 2. The above restriction shall not apply to fire, police or other emergency vehicles, public works vehicles in the performance of maintenance work, school buses, motor coaches licensed for the commercial transportation of passengers, trucks or other vehicles which are making service calls or deliveries to residences, businesses and construction sites located on said streets, or vehicles participating in approved parades or events. Section 3. That any person, firm or corporation who shall violate any of the provisions of this Ordinance shall, upon conviction, be fined, not to exceed, Two Hundred Dollars ($200.00) for each offense. Section 4. That the provisions of all Ordinances in conflict with the provisions of this Ordinance which insofar as the same do conflict therewith be, and the same are hereby, repealed.
