ORDINANCE NO. 2012-45 <br /> AN ORDINANCE PROHIBITING VEHICLES WITH MORE THAN SIX WHEELS ON <br /> - FRANKLIN STREET BETWEEN WOOD STREET AND ELDORADO STREET - <br /> -WATER STREET BETWEEN WOOD STREET AND ELDORADO STREET - <br /> -MAIN STREET BETWEEN WOOD STREET AND ELDORADO STREET - <br /> WHEREAS, The City of Decatur is granted authority under 625 ILCS 5/15-316 to establish <br /> ordinances prohibiting the operation of trucks or other commercial vehicles on highways under their <br /> jurisdiction; and, <br /> WHEREAS, Franklin Street, Water Street and Main Street between Wood Street and Eldorado <br /> Street are under the jurisdiction of the City of Decatur; and, <br /> WHEREAS, the allowance of through vehicles with more than six wheels on certain downtown <br /> streets has raised safety and quality of life concerns. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF <br /> DECATUR, ILLINOIS: <br /> Section 1. That when appropriate signs or markings are installed giving notice thereof, all <br /> vehicles having more than six wheels, including vehicles pulling trailers, are prohibited and excluded <br /> from the use of the following streets: <br /> Franklin Street between Wood Street and Eldorado Street <br /> Water Street between Wood Street and Eldorado Street <br /> Main Street between Wood Street and Eldorado Street <br /> Section 2. The above restriction shall not apply to fire, police or other emergency vehicles, <br /> public works vehicles in the performance of maintenance work, school buses, motor coaches licensed <br /> for the commercial transportation of passengers, trucks or other vehicles which are making service <br /> calls or deliveries to residences, businesses and construction sites located on said streets, or vehicles <br /> participating in approved parades or events. <br /> Section 3. That any person, firm or corporation who shall violate any of the provisions of <br /> this Ordinance shall, upon conviction, be fined, not to exceed, Two Hundred Dollars ($200.00) for <br /> each offense. <br /> Section 4. That the provisions of all Ordinances in conflict with the provisions of this <br /> Ordinance which insofar as the same do conflict therewith be, and the same are hereby, repealed. <br />
