2-0 <br /> ORDINANCE NO. 2011-77 <br /> ORDINANCE AMENDING CITY CODE <br /> - CHAPTER 73.1 — TRUANCY - <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That Sections 4, 5, 6 and 7 of Chapter 73.1 be, and the same are hereby, <br /> modified and amended so that said Sections 4, 5, 6 and 7 shall provide as follows: <br /> 4. ENFORCEMENT. Before taking any enforcement action under this chapter, <br /> a police officer shall ask the apparent offender's age and reason for being in the <br /> public place. The officer shall not issue a Violation Notice and Complaint or make <br /> an arrest under this chapter unless the officer reasonably believes that an offense has <br /> occurred and that, based on any response and other circumstances, no defense in <br /> paragraph 3 is present. <br /> 5. VIOLATION NOTICE AND COMPLAINT. <br /> A. Whenever a police officer witnesses or has knowledge, based on reasonable <br /> grounds, of a violation by any person of any section of this Chapter, said police <br /> officer may issue such person a Violation Notice and Complaint as set forth in <br /> Chapter 29 of this Code. <br /> B. A person cited for a violation of any section of this Chapter as herein <br /> provided may terminate any further proceedings by the City due to said violation by <br /> making payment to the City at the office of the City Treasurer. Payment will be <br /> considered as being made only when the City Treasurer is in receipt of the full <br /> amount. <br /> 6. NOTICE. In each instance where a Violation Notice and Complaint is <br /> issued to a Minor for violation of this Chapter, the minor's parent or guardian shall <br /> be issued a "Notice of Violation", notifying said parent or guardian of the charge <br /> made against the minor. <br />
