Once a Violation Notice and Complaint is filed, a hearing is set and held.
Depending on the outcome of the hearing, an order of some sort will be entered. The
order could include fines, costs, restitution, injunctions, orders to correct violations or
other similar directives. The code also provides for the procedures for appeals which
would be taken under the Administrative Review Act of Illinois statutes currently in
effect.
Chapters 34 and 73 include additional violations that would be permitted to be
cited as ordinance violations in appropriate circumstances.
Most chapters in our City Code include a penalty section for violation of any
sections of that chapter. Those chapters need to be amended to reflect the issuance of
the Violation Notice and Complaint, and make reference to adjudication through
Chapter 29 of the Code.
City staff will be available to answer any questions Council may have. If you
have questions or want to discuss, please contact Ryan McCrady, City Manager at
424.2801 or Wendy Morthland, Corporation Counsel at 424.2807.
Attachments
cc: John Robinson
Amy Waks
Mike Frazier
