Excerpts from Plan Commission Minutes of August 4,2011 continued:
Mr. John stated that it seems like vacating the area there would no longer be an option to make a
street that connected through if the golf course ever decided to close.
Mr. Robinson stated that the City always has the right of condemnation so for example in 30
years if there is a change in use, the City could acquire the property at market value.
Mr. John stated that when vacating property, the city gets paid almost nothing for it and there is a
public interest in looking out for future options.
Mr. Rogers was sworn in by Mrs. Althoff.
Mr. Rogers stated that the area in question is a gravel path running through his front yard and
that the gravel path is not maintained by the City. Mr. Rogers stated that people park there late
at night. Mr. Rogers stated that he talked to the South Side Country Club Board and they were
fine with the vacation. Mr. Rogers stated that he would still allow golf carts to use the path and
he would not fence it off. Mr. Rogers gave Southside Country club permission in writing that if
they ever needed to use it they could.
Ms. Stickle stated that there would be a 10 foot ingress/ egress easement required that runs along
the property line.
It was moved and seconded (Smith/Peck) to forward Cal. No. 11-11 to the City Council with
recommendation for approval as presented by staff. Motion carried unanimously.
