Book : 4163 Page : 286 <br /> WHEREAS, said portions of said streets are no longer useful to the public or <br /> to the City or to the owner of the property abutting thereon as right-of-way; and, <br /> WHEREAS, the public interest will be subserved by vacating said portions <br /> of said streets and the public will be relieved from the further burden and <br /> responsibility of maintaining the same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> THE CITY OF DECATUR, ILLINOIS: <br /> Section 1. That the above described portions of streets be, and the same are <br /> hereby, vacated as public streets inasmuch as the same are no longer required for <br /> public use and the public interest will be subserved by such vacation, said portions <br /> of streets being shown on the plat thereof hereto attached and hereby made a part <br /> hereof. <br /> Section 2. That the benefits which will be accrued to the owner of abutting <br /> property by reason of the vacation aforesaid is determined to be, in the judgment of <br /> the Council, equal to the sum of Twenty Seven Thousand Five Hundred Dollars <br /> ($27,500.00). <br /> Section 3. (A) That the vacation herein provided for is made upon the <br /> express condition that there shall be paid to the City of Decatur, Illinois, by Archer <br /> Daniels Midland Company, the sum of $27,500.00 as compensation for the <br /> benefits determined as above set out herein, whereupon such vacation shall <br /> become effective and title to said portions of streets shall be vested in Archer <br /> Daniels Midland Company as provided by law. <br /> (B) The permanent index number of the property acquiring title to the <br /> property vacated hereby is 04-13-06-476-003. <br /> Section 4. That there is hereby reserved in, over, along and under the above- <br /> described streets to the City of Decatur, Illinois, and to the public and to those <br /> utilities and companies as the case may be owning public service facilities, mains, <br /> sewers, telephone and electric, City street lights, circuitry and conduit or other <br /> public utilities, such property, rights of way and easements as are or may be <br /> necessary or desirable for continuing public service by means of such facilities and <br /> for the maintenance, renewal and reconstruction thereof with the right of ingress <br /> and egress for such purposes. <br />
