ORDINANCE NO. 2011-39 <br /> ORDINANCE AMENDING <br /> PLANNED DEVELOPMENT DISTRICT <br /> - GRAND OAKS ESTATES, LLC - <br /> -2225 SOUTH MT. ZION ROAD— <br /> WHEREAS, on the 2nd day of June, 2011, upon due notice, the Decatur City Plan <br /> Commission held a public hearing upon the petition of Grand Oaks Estates, LLC, to modify and <br /> amend the Planned Development District on premises situated in the City of Decatur, Illinois, <br /> and described as follows: <br /> Lots 1, 2, 3, and 4 of Grand Oaks Estates Addition as per Plat recorded in Book <br /> 500, Page 112 of the Records in the Recorder's Office of Macon County, Illinois; <br /> and, <br /> WHEREAS, the Decatur City Plan Commission did report its findings and did <br /> recommend that the modification of said Planned Development District as requested be <br /> authorized. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the report and recommendation of the Decatur City Plan Commission be, <br /> and the same is hereby, received, placed on file and approved. <br /> Section 2. That upon the conditions set forth below, the aforesaid Planned Development <br /> District be, and the same is hereby, modified and amended, and petitioner be, and it is hereby, <br /> authorized and permitted to develop the premises described above in accordance with the site <br /> plan hereto attached, marked Exhibit A and hereby made a part hereof <br /> a. Final site, landscaping and lighting plans shall be submitted to and approved by the <br /> Department of Planning and Building Services, Public Works Department and the Fire <br /> Department prior to building permits being released. <br /> b. Landscaping Plan: The previously approved American Arborvitae must be replaced by a <br /> comparable tree in overall size at maturity. <br /> c. Landscaping Plan: All shrubs must meet a minimum installation size of 24" in height or <br /> spread at time of installation. <br />
