SECTION II. DEFINITIONS <br /> For the purpose of this Ordinance, certain terms and words are herewith defined as listed herein. <br /> Terms used in this Ordinance shall have their customary meanings except that terms of art in the <br /> legal, engineering, land surveying, and planning professions shall be used in the professional <br /> sense. <br /> Words used in the present tense include the future; words in the singular number include the <br /> plural, and words in the plural number include the singular; the word "building" includes the <br /> word "structure"; the word "shall" is mandatory and not permissive. Masculine pronouns refer <br /> equally to persons of either gender unless the context clearly indicates otherwise. <br /> ACCESS DRIVE: Any driveway that provides for the movement of vehicles to or from the <br /> public roadway system. <br /> ACCESSORY BUILDING, STRUCTURE OR USE: A building or use which(a) Is <br /> subordinate to, and serves a principal building or principal use, and is located on the same lot <br /> as said principal building or use; and(b) Is subordinate in height, extent, and purpose to the <br /> principal building or principal use served; (c) The aggregate gross floor area of all accessory <br /> structures does not exceed the ground floor area of the main building, except that a minimum <br /> gross area of 750 square feet for such accessory building or aggregate areas of two or more <br /> buildings shall be permitted; and(d) Is naturally and normally incidental to that of the <br /> dominant use of the main building or land. A distance of eight(8) feet shall separate an <br /> accessory structure and the main structure or other accessory structure. <br /> (Amended, Ordinance No. 2005-105, December 19, 2005) <br /> ADULT ENTERTAINMENT ACTIVITY: An establishment having as a substantial or <br /> significant portion of its business the sale,rental, display, exhibition, or viewing of books, <br /> magazines, films,photographs, sexual paraphernalia or other materials distinguished by or <br /> characterized by an emphasis on matter depicting, describing or relating to sexual conduct or <br /> specified anatomical areas as defined herein. <br /> ADULT ENTERTAINMENT CABARET: A nightclub,theater, or other establishment that <br /> features live performances by topless and/or bottomless dancers, go-go dancers, exotic <br /> dancers, strippers or similar entertainers where such performances are distinguished by or <br /> characterized by an emphasis on sexual conduct of specified anatomical areas as defined <br /> herein. <br /> ADULT ENTERTAINMENT USE: Sex-related or oriented establishments providing adult <br /> services,products or entertainment including but not limited to adult entertainment activity, <br /> adult entertainment cabaret, model studios, adult picture arcades or adult motion picture <br /> theaters, and similar establishments. <br /> ADULT MOTION PICTURE THEATER: An establishment, other than an adult picture arcade, <br /> in an enclosed building wherein slides or movies are presented for observation by patrons for <br /> a substantial or significant portion of its presentations because the same contain material <br /> distinguished or characterized by emphasis on matters depicting, describing or relating to <br /> sexual conduct or specified anatomical areas as defined herein. <br /> 1 EXHIBITA <br />
