Excerpts from Plan Commission Minutes of February 3,2011: <br /> Cal.No. 11-01 Petition of ST. PAUL'S LUTHERAN CHURCH to <br /> rezone property located at 1 BACHRACH COURT, <br /> from M-1 Intense Commercial/Light Industrial <br /> District to B-2 Commercial District. <br /> Mrs. Stewart presented the recommendation of staff: <br /> On October 1, 2009 the City Plan Commission voted 6-0 to approve a rezoning from M-1 <br /> Intense Commercial-Light Industrial District to B-2 Commercial District. The petition was held <br /> at the petitioners request and was never forwarded on to City Council. Since it has been over <br /> one (1) year's time the petition has to come back to Plan Commission before it can be forwarded <br /> to City Council. <br /> The subject site is located at One Bachrach Court and is currently developed as a 136,000 square <br /> foot warehouse/office building with a parking lot and retention pond on approximately 47 acres. <br /> The petitioner proposes to rezone the five (5) lots from M-1 Intense Commercial-Light Industrial <br /> District to B-2 Commercial District in order to relocate their church which is currently located at <br /> the corner of Wood Street and Edward Street. A church is a permitted use in the B-2, <br /> Commercial District. St. Paul's ministry has grown and expanded over the last 146 years and the <br /> church is in need of a larger facility to hold their worship services. <br /> The surrounding zoning includes R-1 Single-Family Residence District and County to the north; <br /> B-1 Neighborhood Shopping District, B-2 Commercial District and M-1 Intense Commercial- <br /> Light Industrial District to the south; R-1 Single-Family Residence District, R-5 Two Family <br /> Residence District and County to the east; and M-1 Intense Commercial-Light Industrial District <br /> to the west. The Decatur Urban Area Land Use Plan shows this area as a mixed use area. The <br /> proposed use is compatible with adjacent uses to the east and south of the area. The down <br /> zoning to B-2 Commercial District should not have an adverse effect of the surrounding area <br /> since a warehouse/office building was at this particular location for a number of years and it has <br /> not appeared to have had an adverse effect on the neighborhood. <br /> Staff recommends approval of the rezoning. <br /> Section XXIX. requires the Plan Commission to hold a public hearing on a rezoning request, and <br /> then forward its report and recommendation to the City Council for final approval. A motion to <br /> forward Calendar Number 11-01 to the City Council with a recommendation for approval is <br /> suggested. <br /> Mr. Phil Cochran, representative, said this is the exact same petition that was approved by the <br /> Plan Commission on October 1, 2009. There was a contract for the purchase of the property but <br /> the financing was not in place. Since it has been over one (1) year's time the petition has to <br /> come back to Plan Commission before it can be forwarded to City Council. With the financing <br /> in place, St. Paul's is ready to move forward with the project and asks for the approval of the <br /> Commission. <br /> There were no objectors present. <br /> It was moved and seconded (Dial/Peck) to forward Cal. No. 11-01 to the City Council with <br /> recommendation for approval as presented by staff. Motion carried unanimously. <br />
