ORDINANCE NO. 2011-10 <br /> AN ORDINANCE REZONING PROPERTY <br /> - 3350 NORTH WATER STREET - <br /> WHEREAS, on the 3rd day of February, 2011, upon due notice, the Decatur City Plan <br /> Commission held a public hearing upon the petition of B & R Development, LLP to rezone <br /> premises legally described as: <br /> Lots 1, 2, 3 and 4 of the Resurvey of Lots 119 thru 123 of Holiday Hills Second <br /> Addition as per Plat recorded in Book 300, Page 408 of the records in the <br /> Recorder's Office, Macon County, Illinois. And the vacated Right-of-Way of <br /> Holiday Court, <br /> from R-3 Single Family Residence District to PD Planned Development; and, <br /> WHEREAS, the Decatur City Plan Commission recommended that the prayer of said <br /> petition be granted. <br /> NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the recommendation of the Decatur City Plan Commission be, and the <br /> same is hereby, received, placed on file and approved. <br /> Section 2. That under the conditions set forth below said above described premises be, <br /> and they are hereby, rezoned from R-3 Single Family Residence District to PD Planned <br /> Development: <br /> a. The site break fence shall be located between the required buffer yard and the parking lot <br /> and refuse area. <br /> b. Fifty percent of the required parking lot points shall consist of shade trees. <br />
