PUBLIC WORKS MEMORANDUM NO. 2011-08 DATE: January 28, 2011 TO: Honorable Mayor McElroy and City Council Members FROM: Ryan P. McCrady, City Manager Richard G. Marley, P.E., Public Works Director SUBJECT: Repealing City Code Chapter 72, Sewer User Charge SUMMARY RECOMMENDATION: It is recommended that the City Council repeal City Code Chapter 72, Sewer User Charge. The language in Chapter 72 will be moved into Chapter 74 so that all City Ordinance requirements concerning sanitary sewers are contained in one City Code Chapter. Chapter 72 will be empty and reserved for other future use. PRIOR COUNCIL ACTION: • November 1, 2010—The City Council met in Study Session to discuss the Big Four Projects; Water Infrastructure, Sanitary Sewer Infrastructure, Stormwater Infrastructure and the Police Department Space Needs. CODE AMENDMENT: City Code Chapter 72 "Sewer User Charge" is proposed to be placed into City Code Chapter 74 "Sewer Service and Connections"which is to be re-titled "Sanitary Sewer System." This action simplifies the codes by combining all sanitary sewer ordinance regulations into one chapter. This reduces overlapping information and makes it easier to find all information about the City's sanitary sewer system standards and costs. City Council will be presented with an ordinance to amend City Code Chapter 74, Sanitary Sewer System at the February 7, 2011 City Council Meeting. POTENTIAL OBJECTION: None. INPUT FROM OTHER SOURCES: None. STAFF REFERENCE: Richard Marley, Public Works Director will be in attendance at the City Council meeting to answer any questions of the Council on this item.
