r <br /> ORDINANCE NO. 2010-73 <br /> AN ORDINANCE AMENDING ORDINANCE NO. 77-33 "AN ORDINANCE <br /> setting forth the determination of the Council of the City of Decatur, Macon <br /> County, Illinois, that it is in the public interest to assist hospitals serving residents <br /> of the City in financing hospital facilities, and prescribing the procedures to be <br /> followed in the issuance of Hospital Facility Revenue Bonds by the City." <br /> WHEREAS, Section 6(a) of Article VII of the 1970 constitution of Illinois provides that <br /> "any municipality which has a population of more than 25,000 (is) a Home Rule Unit", and the <br /> City of Decatur, Macon County, Illinois (the "City"), has a population in excess of 25,000 and is <br /> therefore a Home Rule Unit and may under the powers granted by Section 6(a) of Article VII <br /> "exercise any power and perform any function pertaining to its government and affairs..."; and <br /> WHEREAS, in furtherance of such powers the Council of the City of Decatur (the "City <br /> Council") has heretofore adopted Ordinance 77-33 entitled the "City of Decatur Hospital Facility <br /> Revenue Bond Enabling Ordinance" (as previously supplemented and amended, the "Original <br /> Enabling Ordinance"); and <br /> WHEREAS, the City Council has heretofore found and does hereby find that it is <br /> necessary and in the best interests of the City that the Original Enabling Ordinance be amended <br /> to authorize the issuance of bonds to refund in whole or in part bonds issued by an issuer other <br /> than the City; <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Decatur, Macon <br /> County, Illinois, as follows: <br /> Section 1. That Section (6) of the Original Enabling Ordinance is amended by <br /> deleting it in its entirety and substituting therefor the following: <br /> "(6) To issue its bonds to refund, in whole or in part, bonds theretofore <br /> issued by the City under the authority of this Ordinance, or any other bonds issued <br /> by another governmental issuer for the benefit of a Hospital." <br /> Section 2. That the provisions of this Ordinance are hereby declared to be separable, <br /> and if any section, phrase or provision shall for any reason be declared to be invalid, such <br /> declaration shall not affect the validity of the remainder of the sections, phrases or provisions. <br /> CHI-1 773 08 5v2 <br />
