Excerpts from Plan Commission Minutes of July 1, 2010: <br /> Cal. No. 10-12 GRAND OAKS ADDITION-Access Easement <br /> located in the 2200 Block South Mt. Zion Road. <br /> Mrs. Stewart presented the recommendation of staff: <br /> The subject site has a single family residential structure and shed. <br /> The proposed Preliminary Minor Plat of Grand Oaks Estates Addition was reviewed and <br /> approved by Engineering, Fire and Planning for the access easement. The owner proposes to <br /> subdivide the property into four (4) lots in which three (3) of the lots will not have frontage or <br /> direct access to a public street. According to the Zoning Ordinance each lot shall have frontage <br /> on, direct access to, a public street or way that is improved to City standards, unless the Council <br /> shall otherwise direct, by approval of a subdivision plat so showing submitted, heard and <br /> considered in the manner provided in the subdivision Regulations for the City. <br /> The petitioner considered two (2) options for this "L" shaped parcel. Their options were to <br /> either have one (1) lot with access to IL Route 121 or develop the site as shown on the plat with <br /> Ingress/Egress Easements to Lots 2, 3, and 4. The access to proposed Lots Two (2), Three (3) <br /> and Four (4) of Grand Oaks Estates Addition will be from a private road along the north side of <br /> the proposed subdivision. The developer has chosen to develop the parcel as shown due to <br /> independent ownership potential for each facility and certain financing requirements for the <br /> various uses. <br /> The access to proposed Lots Two (2), Three (3) and Four (4) of Grand Oaks Estates Addition <br /> will be from a private road along the north side of the proposed subdivision. <br /> Common ingress/egress and utility easements are being platted to provide full access to the <br /> building sites. <br /> Staff recommends approval of the petition. <br /> Section IV.A.8. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold a <br /> public hearing to review Plats when there is no direct access to a public street and report its <br /> findings to the City Council. A motion to forward Calendar Number 10-12 to the City Council <br /> with a recommendation for approval is suggested. <br /> Mr. Bob Dean said this subdivision is part of the Grand Oaks plan. The developer has chosen to <br /> develop the parcel due to independent ownership potential for each facility and certain financing <br /> requirements for the various uses. <br /> There were no questions and no objectors present. <br /> It was moved and seconded (Peck/Dial) to forward Cal. No. 10-12 to the City Council with <br /> recommendation for approval as presented by staff. Motion carried unanimously. <br />
