Excerpts from Plan Commission Minutes of July 1, 2010:
Cal.No. 10-17 Petition of MASON MANUFACTURING, LLC, to
vacate the Alleyway located in the 1600/1700 Blocks of
North Clinton Street and North Railroad Avenue.
Ms. Stickle presented the recommendation of staff:
The petitioner is requesting vacating the alleyway in the 1600/1700 Blocks of North Clinton
Street and North Railroad Avenue. The vacation will enable the petitioner to control the alley
and utilize the area as part of its current facilities as the petitioner owns a majority of the
property on both sides of the alleyway.
All property owners adjacent to the alley have been notified by the petitioner regarding the
vacation and one (1) objection has been expressed by the owners of 1654 North Clinton Street
and have asked the Plan Commission to table this item. The petitioner owns all other adjacent
properties.
Letters were sent to AmerenIP, Comcast Communications, and AT&T notifying the utility
companies of the vacation request and no objections to the proposed alleyway vacation were
expressed.
An appraisal was conducted on the property. The proposed vacated property has an estimated
market value of$2,000.00 which will be paid to the City.
The formal vacation of this alleyway does not appear that it will have an adverse affect on the
general public. The alleyway appears to have been gated for several years and utilized by the
company as part of their facility.
Staff recommends approval of the alleyway vacation with the following conditions:
1. All easements shall be maintained.
A motion to forward the vacation request of Calendar Number 10-17 to the City Council with a
recommendation for approval is suggested.
Mr. Mickler said he is in possession of a letter from someone who is opposing this vacation. Ms.
Stickle said the letter was not part of the staff report because it was received after the packets
went out to the Commission members. Each member was sent a copy of the letter the day staff
received it.
Mr. Edwards asked if this was a residential facility or a business that opposes this item. Ms.
Stickle said it was a single family home that has the windows boarded up and is painted gray like
the rest of the Mason facility is painted. It has a garage in the back that has a garage door and a
pedestrian door facing west that could have been accessed at one point as there is gravel under
the grass leading back to the garage. There is also a door on the back which leads to the alley at
an angle.
Chairman Dave Anderson said he missed the entrance on the west side. Ms. Stickle said the curb
cut is there and at one time there was a gravel drive.
