Eaton, Recorder Book: 4087 Page: 799 ` 1800'754 Receipt •;Recorded: Recording5.00 Pages Recorded: 9 Authorized By: ate Recorded: 9/9/2010 8:23:19 AM ORDINANCE NO. 2010-53 ORDINANCE VACATING PORTION OF ALLEY - 100 BLOCK SOUTH OAKLAND AVENUE - WHEREAS, a request has been received from Gregg Meisenhelter requesting the vacation by the City Council of a portion of an alley in the City of Decatur, Illinois legally described as: A part of the existing Fourteen (14) foot Alley Right of Way, said part described as follows: The West 80.00 feet of the 14.00 foot Alley adjacent to the East Right of Way line of South Oakland Avenue and adjacent to Lot Six (6) and the West 20.00 feet of Lot Five (5) in H.S. Evans Subdivision as per Plat recorded in Book 97, Page 321 of the Records in the Recorder's Office, Macon County, Illinois on the North side and adjacent to Lot One (1) and the West 20.38 feet of Lot Two (2) in the IKE Subdivision as per Plat recorded in Book 5000, Page 58 of the Records in the Recorder's Office, Macon County, Illinois on the South side, containing 1,120 square feet, more or less; and, WHEREAS, said portion of alley is no longer useful to the public or to the City or to the owner of the property abutting thereon as an alley; and, WHEREAS, the public interest will be subserved by vacating said portion of alley and the public will be relieved from the further burden and responsibility of maintaining the same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That upon the conditions set forth below, the above described portion of alley be, and the same is hereby, vacated inasmuch as the same is no longer required for public use and the public interest will be subserved by such vacation, said portion of alley being shown on the plat thereof hereto attached and hereby made a part hereof:
