LEGAL DEPARTMENT MEMORANDUM
NO. 2010-11
July 6, 2010
TO: Honorable Mayor McElroy and City Council
FROM: Ryan McCrady, City Manager
Wendy Morthland, Corporation Counsel
Amy Waks, Assistant Corporation Counsel
SUBJECT: Amendments to Chapter 50.1 —Transient Merchants
SUMMARY RECOMMENDATION: Staff requests that Council pass the proposed
ordinance amendment regarding Chapter 50.1, regarding Transient Merchant licenses.
BACKGROUND: The City of Decatur has experienced a rise in the incidents of solicitors
and peddlers which fall under the definition of Transient Merchants and/or Itinerant
Vendors. While the City Code includes a Chapter on Transient Merchants, the current
ordinance is unclear as to what activities the requirement of a license includes as well as
exceptions.
RECOMMENDATION: Staff recommends the passage of the proposed ordinance in order
to allow for the better regulation of transient merchants and itinerant vendors.
POTENTIAL OBJECTIONS: There are no known or expected objections.
INPUT FROM OTHER SOURCES:
STAFF REFERENCE: Am Waks, Assistant Corporation Counsel, at 424-2807.
Y P
BUDGETITJME IMPLICATIONS: None
cc: John Robinson
Amy Waks
