Eaton, Recorder <br /> Book: 4068 Page: 653 <br /> Recit *: 31654 Recording Fee: 130.00 <br /> Pegea Recorded: 4 Authorized By:Recorded: 6/9/2010 2:53:49 PM <br /> 179555 IIIIIIIIII,IIIIIIIIIIIIIIIIIIIII IIIIIIIIIII III IIIIIIIIIIIIIII IIIII <br /> ORDINANCE NO. 2010-37 <br /> ORDINANCE VACATING PUBLIC RIGHT-OF-WAY <br /> - 4200 BLOCK EAST LAKE SHORE DRIVE - <br /> WHEREAS, a request has been received from James Allen King, requesting the vacation <br /> by the City Council of a portion of public right-of-way in the City of Decatur, Illinois described <br /> as: <br /> Commencing at a P.K. nail at the Southwest Corner of the 15 foot Path vacated by <br /> Ordinance No. 2001-14 and recorded in Book 3047, Page 88 of the records in the <br /> Recorder's Office of Macon County, Illinois; thence N. 29°00'00" E., 7.81 feet on <br /> the Easterly Right-of-Way of East Lake Shore Drive to the Point of Beginning; <br /> thence N. 05°12'23" E., 9.42 feet to a point on the Southerly Right-of-Way of <br /> East Lake Shore Drive; thence S. 46°47'37" E,. 3.92 feet on said Right-of-Way to <br /> a drill hole; thence S 29°00'00" W., 7.66 feet to the point of beginning. <br /> Containing in all 14.54 square feet more or less; and, <br /> WHEREAS, said portion of right-of-way is no longer useful to the public or to the City <br /> or to the owner of the property abutting thereon as right-of-way; and, <br /> WHEREAS, the public interest will be subserved by vacating said portion of right-of- <br /> way and the public will be relieved from the further burden and responsibility of maintaining the <br /> same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the above described portion of right-of-way be, and the same is hereby, <br /> vacated as public right-of-way inasmuch as the same is no longer required for public use and the <br /> public interest will be subserved by such vacation, said right-of-way being shown on the plat <br /> thereof hereto attached and hereby made a part hereof. <br /> Section 2.
