Crowe, Assistant City Manager <br /> Suzan M. Stickle, Senior Planner <br /> SUBJECT: Vacation of Right of Way at 4275 East Lake Shore Drive <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the right of way <br /> vacation. <br /> BACKGROUND: The petitioner is requesting vacating a portion of the right of way in the 4200 <br /> Block of East Lake Shore Drive. The right of way vacation will enable the petitioner to square <br /> off the proposed lot line of King's Lake Shore Estate subdivision. The proposed subdivision is <br /> required in order to construct a proposed garage which was approved for a variance by the <br /> Zoning Board of Appeals on May 13, 2010. <br /> The City Administrative Policy does not require a vacation to be heard by the Plan Commission <br /> for a public hearing in cases of unusual circumstances. No appraisal for the right of way <br /> vacation will be required since the area is only approximately 14.54 square feet and has been <br /> used by the previous owners as part of the driveway/parking area for many years. <br /> The formal right of way vacation will not have an adverse affect on the general public. <br /> The right of way is not necessary to serve the general public. Staff is of the opinion that the best <br /> interests of the City of Decatur would be served by approving the right of way vacation. <br /> POTENTIAL OBJECTION: N/A <br /> INPUT FROM OTHER SOURCES: The vacation has been reviewed and approved by <br /> Planning, Engineering and Fire. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Suzan M. Stickle at 424- <br /> 2786 or at sstickle(c�r�,decaturil.gov. <br /> BUDGET/TIME IMPLICATIONS: None. <br />
