Stewart, Transportation Plannerk-42 SUBJECT: Vacation of the Right-of-Way in the 100 Block of South State Street SUMMARY RECOMMENDATION: Staff recommends approval of the right-of-way vacation with the following conditions: 1. Street Lights/Light Circuit: Remove all street lights, poles and fixtures on State Street. Replace the removed foundations with hand holes or Public Works approved covering. Re-route the conduit and wire into hand hole. Two options are available: a.) Provide a permanent easement for the existing conduit and controller or b.) Remove and reconstruct the circuit into two separate circuits. Coordinate with the Public Works Department; 2. The Orlando Apartments will have the exclusive use of five (5) parking spaces in the vacated State Street right-of-way; said parking spaces will be specifically marked; 3. That there will be continuous access to the East side of the Orlando building for ingress/egress of residents, the pick-up and delivery of building related materials and goods and refuse pick-up. The Ci Plan Commission voted 7-3 to recommend approval of this petition at the March 4, City pp 2010 meeting; the minutes of the meeting are attached. BACKGROUND: The petitioner is requesting vacating the right-of-way in the 100 Block of State Street. The vacation will enable the petitioner to create additional parking adjacent to his building. Decatur Properties of Illinois, L.P. has been notified by the petitioner regarding the vacation and has no objections. The petitioner owns all other adjacent properties. Letters were sent to AmerenIP, Comcast Communications, and AT&T notifying the utility companies of the vacation request and no objections to the proposed right-of-way vacation were expressed. Because there is only one (1) licensed commercial appraiser in the City of Decatur, only one (1) appraisal was conducted on the property. The proposed vacated property has an estimated market value of$47,500.00 which will be paid to the City.
