No. 10-01 Petition of TONY ROMANO to vacate the Right- <br /> of-Way in the 100 BLOCK of SOUTH STATE <br /> m <br /> STREET. <br /> Mrs. Joselyn Stewart was sworn in by Mrs. Janet Poland. <br /> 0 Mrs. Stewart presented the recommendation of staff: <br /> 0 <br /> XQ The petitioner is requesting vacating the right-of-way in the 100 Block of State Street. The <br /> vacation will enable the petitioner to create additional parking adjacent to his building. <br /> Decatur Properties of Illinois, L.P. has been notified by the petitioner regarding the vacation and <br /> has no objections. The petitioner owns all other adjacent properties. <br /> Letters were sent to AmerenIP, Comcast Communications, and AT&T notifying the utility <br /> companies of the vacation request and no objections to the proposed right-of-way vacation were <br /> expressed. <br /> Because there is only one (1) licensed commercial appraiser in the City of Decatur, only one (1) <br /> appraisal was conducted on the property. The proposed vacated property has an estimated <br /> market value of$47,500.00 which will be paid to the City. <br /> The formal vacation of this right-of-way will not have an adverse affect on the general public. <br /> The right-of-way is not necessary to serve the general public. Staff is of the opinion that the best <br /> interests of the City of Decatur would be served by approving the right-of-way vacation. <br /> Staff recommends approval of the right-of-way vacation with the following conditions: <br /> a. Street Lights/Light Circuit: Remove all street lights, poles and fixtures on State Street. <br /> Replace the removed foundations with hand holes or Public Works approved covering. <br /> Re-route the conduit and wire into hand hole. Two options are available: 1) Provide a <br /> permanent easement for the existing conduit and controller or 2) Remove and reconstruct <br /> the circuit into two separate circuits. Coordinate with the Public Works Department. <br /> b. Easements will be maintained. <br /> c. The Orlando Apartments will have the exclusive use of five (5) parking spaces in the <br /> vacated State Street right-of-way; said parking spaces will be specifically marked. <br /> d. That there will be continuous access to the East side of the Orlando building for <br /> ingress/egress of residents, the pick-up and delivery of building related materials and <br /> goods and refuse pick-up. <br /> The Administrative Policy of the City of Decatur requires that property vacation requests be <br /> submitted to the Plan Commission for a public hearing. Although a Plan Commission <br /> recommendation is not required, a motion to forward the vacation request of Calendar Number <br /> 10-01 to the City Council with a recommendation for approval is suggested. <br /> Mr. John Mickler asked who Decatur Properties of Illinois, L.P. represented. Ms. Suzy Stickle <br /> stated it was Orlando Apartments. <br />
