ORDINANCE NO. 2010-10 <br /> AN ORDINANCE of the City of Decatur, Macon County, <br /> Illinois, amending certain prior ordinances of the City providing <br /> for a Line of Credit with National City Bank <br /> WHEREAS, the City of Decatur, Macon County, Illinois (the "City'), is a duly <br /> organized municipality under the laws of the State of Illinois, operating generally under the <br /> Illinois Municipal Code, as amended; has a population in excess of 25,000 as determined by <br /> the last official census; and pursuant to the provisions of Section 6 of Article VII of the <br /> Constitution of the State of Illinois the Cit is a home rule unit and may exercise an ower or <br /> Y Y Yp <br /> perform any function pertaining to its government and affairs, including, but not limited to, the <br /> power to tax and to incur debt (the Illinois Municipal Code as supplemented and, where in <br /> conflict, superseded by said constitutional powers being the "Act'); and <br /> WHEREAS, the Council of the City (the "Council") has previously authorized the <br /> issuance of the City's Amended and Restated Taxable General Obligation Line of Credit Note <br /> (the "Note') in the aggregate principal amount of not to exceed $4,750,000 pursuant to the <br /> Amended and Restated Line of Credit Agreement by and between the City and National City <br /> Bank ("Bank") dated August 16, 2007 as amended from time to time including most recently <br /> by Ordinance Number 2009-35 adopted May 4, 2009 (as so amended, the "Agreement"), all as <br /> P Y <br /> described and defined in the prior ordinances authorizing the Agreement and theNote, <br /> including, Ordinance Number 2006-94 adopted by the Council on October 2, 2006, Ordinance <br /> Number 2007-68 adopted by the Council on August 15, 2007, Ordinance No. 2008-98 adopted <br /> b the Council on December 15 2008 and Ordinance No. 2009-35 adopted on May 4 2009 <br /> Y p Y , <br /> coli cti <br /> ( vel e y, the Note Ordinance ); and <br /> WHEREAS, the Note Ordinance provides for payment of the Note on demand, but <br /> maturing in no event later than December 31, 2009; and <br />
