77. IMMOBILIZATION AND IMPOUNDMENT. <br /> A. The City of Decatur is hereby authorized to immobilize and impound a vehicle <br /> that has accumulated fines of $100 or more for unpaid parking citations issued to the <br /> vehicle by the City, <br /> 13. When a registered owner of a vehicle or vehicles has accumulated unpaid <br /> parking citations of $100 or more, the registered owner shall be sent a notice of <br /> impending immobilization and impoundment by first class mail to the address of the <br /> registered owner of the cited vehicle(s) as recorded with the Illinois Secretary of State or <br /> the state in which the vehicle is registered. Such notice shall state the name and address <br /> of the registered owner, the state registration number of the motor vehicle(s), and a list of <br /> all unpaid parking citations issued to the vehicle(s). Such notice shall be deemed served <br /> as of the date of deposit in the United States mail. <br /> C. Upon receipt of the notice of impending immobilization and impoundment, the <br /> registered owner shall have twenty-one (21) days after the date of the notice to pay all <br /> fines or to submit a written request for a hearing to present documentary evidence that <br /> would conclusively disprove liability. Documentary evidence that would conclusively <br /> disprove liability shall be based on the following grounds: (1) that all fines for the <br /> violations cited in the notice of impending immobilization and impoundment have been <br /> paid in full; or (2) that the registered owner has not accumulated fines of$100 or more <br /> that were unpaid at the time the notice of impending immobilization and impoundment <br /> was issued. The written request for a hearing must be submitted within twenty-one (21) <br /> days after the date of the notice of impending immobilization and impoundment to the <br /> City of Decatur's Legal Department. <br /> D. Within ten (10) days after receipt of the written request for a hearing, the City <br /> shall notify by certified mail, return receipt requested, the owner of record of said vehicle <br /> of the date, time and location of an administrative hearing. A hearing shall be scheduled <br /> and held, unless continued by order of the City's hearing officer, on designated days of <br /> each month. The hearing shall be scheduled not less than seven (7) days and not more <br /> than thirty 30 days after notice thereof is mailed. All interested persons shall be given a <br /> reasonable opportunity to be heard at the hearing. The formal rules of evidence shall not <br /> apply and hearsay evidence shall be admissible. The hearing shall be open to the public <br /> and a court reporter shall transcribe the proceedings. <br /> E. If, after the expiration of twenty-one (21) days after the notice of impending <br /> immobilization and impoundment, the outstanding fines remain unpaid, a written request <br /> for a hearing has not been submitted to the City of Decatur's LegalDepartment, if the <br /> owner requesting a hearing fails to appear at such hearing, or after a hearing, the owner <br /> has been found liable, a Parking Meter Checker may cause an immobilization device to <br /> be attached to the eligible vehicle in a manner to prevent the operation of the vehicle <br />
