r <br /> ORDINANCE NO. 2009-91 <br /> AN ORDINANCE OF THE CITY OF DECATUR, ILLINOIS SETTING <br /> FEBRUARY 1, 2010 AS THE PUBLIC HEARING DATE FOR THE PROPOSED <br /> PINES SHOPPING CENTER REDEVELOPMENT PROJECT AREA AND <br /> RELATED MATTERS <br /> WHEREAS, the City of Decatur, Illinois (the "City") is a municipal corporation <br /> established pursuant to the Municipal Code of the State of Illinois and has jurisdiction <br /> over matters pertaining to its government and affairs; <br /> WHEREAS, the City, pursuant to the Tax Increment Allocation Redevelopment <br /> Act, 65 ILCS 5/11-74.4-1 et seq. (the "Act"), is contemplating the adoption of the Pines <br /> Shopping Center Redevelopment Project Area (the "Area") (legal description is attached <br /> hereto) and the Pines Shopping Center TIF Tax Increment Redevelopment Plan and <br /> Projects (the "Plan") and the establishment of Tax Increment Financing for the Area; <br /> WHEREAS, the City Council (the "Corporate Authorities") of the City, in the <br /> interest of due process, wishes to hold a public hearing after proper notice to all interested <br /> parties as required by the Act and to consider the adoption of the Area, the Plan and Tax <br /> Increment Financing after the City receives all public comment from all interested parties <br /> as required by the Act; and <br /> NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE MAYOR <br /> AND CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS THAT: <br /> 1. Pursuant to Section 5 of the Act, a public hearing concerning the adoption <br /> of the Area, Plan and Tax Increment Financing shall be held on Monday, February 1, <br /> 2010 at 5:30 P.M. in the City Council's meeting room at City Hall, 1 Gary K. Anderson <br /> Plaza in Decatur, Illinois. <br /> 2. From and after the effective date of this Ordinance, the proper officers, <br /> agents and employees of the City are hereby authorized, empowered and directed to do <br /> all such acts, including the sending of appropriate notices as required by the Act, and to <br /> execute all such documents as may be necessary to carry out the intent and accomplish <br /> the purposes of this Ordinance. <br /> 1 <br />
