r <br /> Excerpts from Plan Commission Minutes of November 5, 2009 <br /> Cal. No. 09-51 Petition of DOUG AND KELLY NICHOLS to <br /> rezone property located at 3601 Redlich Drive, from <br /> R-1 Single Family Residence District to R-3 Single <br /> Family Residence District. <br /> Ms. Suzy Stickle was sworn in by Mrs. Poland. <br /> Ms.Stickle presented the recommendation of staff: <br /> The subject site is undeveloped. The subject site is currently located in the County. An <br /> annexation agreement has been received and filed by the City Council on Monday, November 2, <br /> 2009. <br /> The subject petition requests rezoning to R-3 Single Family Residence District to allow for the <br /> construction of an accessory structure. The petitioner intends to annex the property located to <br /> the East of their current residence, rezone to match the existing zoning, submit a minor <br /> subdivision plat to create one (1) lot so they may construct an accessory structure. <br /> The proposed rezoning is consistent with the character of the surrounding neighborhood and <br /> general area. The surrounding zoning includes R-3 Single Family Residence Districts to the <br /> East, West and North, the property to the South is located in the County. The proposed rezoning <br /> is consistent with the intent of the Comprehensive Plan. <br /> Based on the analysis, staff recommends approval of the rezoning. <br /> Section XXIX of the Zoning Ordinance requires the Plan Commission to hold a public hearing <br /> on a rezoning request and forward its report and recommendation to the City Council for final <br /> approval. A motion to forward Calendar Number 09-51 to the City Council with a <br /> recommendation for approval is suggested. <br /> Mr. Ed Flynn, representative, was sworn in by Mrs. Poland. <br /> Mr. Flynn stated the lot is currently in the County and there is a good chance the accessory <br /> building will be completed before the annexation is final. <br /> There were no questions and no objectors present. <br /> It was moved and seconded (Dial/Edwards) to forward Cal. No. 09-51 to the City Council with <br /> recommendation for approval as presented by staff. Motion carried unanimously. <br />
