LEGAL DEPARTMENT MEMORANDUM
NO. 2009-12
October 15, 2009
TO: Honorable Mayor McElroy and City Council
FROM: Ryan P. McCrady, City Manager V
Wendy Morthland, Corporation Counsel
Mark Barthelemy, Human Rights Officer
SUBJECT: Chapter 28 — Unlawful Discrimination
This ordinance amends Chapter 28 with two changes. The first would allow the
City Manager to appoint hearing officers for public hearings in unlawful discrimination
cases in case a conflict existed with the Human Rights Commission.
The second amendment would allow, in instances where the Commission or City is
required to actually pay for the services of a hearing officer, for those costs to be
assessed against the losing party.
Staff recommends approval of these amendments.
WLM:pm
cc: John T. Robinson
Amy Waks
