Eaton, Recorder Book: 4037 Page: 397 ° 1787089'�0/'�8�/ � Receipt *: 27949 Recording Fee: 139.00 Page@ Recorded: B Aufhorized By: NRecorded: 12/14/2009 9:09:38 AM ORDINANCE NO. 2009-75 ORDINANCE VACATING PORTION OF STREET - MAPLEWOOD AVENUE - WHEREAS, a request has been received from Tanglewood Village, requesting the vacation by the City Council of a portion of Maplewood Avenue in the City of Decatur, Illinois described as: A part of the existing Sixty (60) foot Right of Way of Maplewood Avenue said part described as follows: Beginning at a point, said point being the intersection of the North Right of Way line of Maplewood Avenue with the West Right of Way line of 34th Street; thence South 15.00 feet; thence West 400.00 feet; thence North 15.00 feet to a point on the said North Right of Way line of Maplewood Avenue, said point also being the Southeast Corner of Lot 5 of Oak Park Estates as per Plat recorded in Book 1832, Page 322 of the Records in the Recorder's Office of Macon County, Illinois; thence East 400.00 feet along the said North Right of Way line of Maplewood Avenue to the Point of Beginning, containing 6000 square feet, more or less; and, WHEREAS, said portion of street is no longer useful to the public or to the City or to the owner of the property abutting thereon as right-of-way; and, WHEREAS, the public interest will be subserved by vacating said portion of street and the public will be relieved from the further burden and responsibility of maintaining the same. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the above described portion of street be, and the same is hereby, vacated as public right of way inasmuch as the same is no longer required for public use and the public
