LEGAL DEPARTMENT MEMORANDUM
NO. 2009-13
October 15, 2009
TO: Honorable Mayor McElroy and City Council
FROM: Ryan P. McCrady, City Manager /
Wendy Morthland, Corporation Counsel
,r
SUBJECT: Chapter 42 — Cable Service and Competitive Video Service
AT&T has recently begun offering cable and video services to residents of the City
of Decatur. The State of Illinois adopted the Illinois Cable and Video Competition Law
in 2007 which allows providers to obtain one State license to provide these services
throughout the State rather than negotiate individual franchise agreements with local
municipalities. AT&T has obtained this State license. The law has very specific
requirements in it.
The amendments to Chapter 42 will allow AT&T or any other State license holder
to operate within the City yet provide some regulations and guidelines.
Staff recommends approval.
WLM:pm
cc: John T. Robinson
Amy Waks
