ORDINANCE NO. 2009-69 ORDINANCE GRANTING CONDITIONAL USE PERMIT - 1551 — 1801 EAST MCBRIDE AVENUE - WHEREAS, on the 3rd day of September, 2009, upon due notice, the Decatur City Plan Commission held a public hearing upon the petition of Modern Scrap, Inc. for a conditional use permit under the provisions of Section XXII.A.2 of the Zoning Ordinance to allow the operation of an industrial and commodity scrap metal processing operation in the M-2 Heavy Industrial District on property located in the City of Decatur, Illinois and legally described as follows: TRACT All of the north 400 feet of the south 653 feet of the Northwest Quarter of the Southwest Quarter of Section One (1), Township 16 North, Range Two East of the 3rd P. M., except the east 499.24 feet thereof and except the west 630 feet, but the east 15 feet of the North 185 feet of the west 630 feet thereof, except the south 50.00 feet of the west 63.00 feet thereof, this parcel is subject to a nonexclusive ingress/egress easement. Situated in Macon County, Illinois. TRACT II The west 299.24 feet of the east 499.24 feet of the following: the north 400.00 feet of the south 653.00 feet of the Northwest Quarter of the Southwest Quarter of Section One (1), Township 16 North, Range Two East of the 3rd P.
