Eaton, Recorder <br /> Book: 4020 Page: 15 <br /> Receipt •: 26202 Recording Fee: 130.00 <br /> Pages Recorded: 3 Authorized By:uAe,.,[].C_ <br /> IL 782689 a Recorded: 9/22/2009 11:50:55 AM <br /> ORDINANCE NO. 2009-67 <br /> ORDINANCE VACATING RIGHT-OF-WAY <br /> - 1200 BLOCK WEST CERRO GORDO STREET - <br /> WHEREAS, a request has been received from Cedarwood Development requesting the <br /> vacation by the City Council of right-of-way in the City of Decatur, Illinois legally described as: <br /> The Sixty (60) foot wide West Cerro Gordo Street Right of Way located between <br /> North Fairview Avenue (IL S.R. 48) and U.S. Route 36; North of and adjacent to <br /> Lots Six (6) thru Ten (10), Block 4, Fairview Addition as per Plat recorded in <br /> Book 149, Page 421 in the records of the Recorder's Office of Macon County, <br /> Illinois; and, <br /> WHEREAS, said right-of-way is no longer useful to the public or to the City or to the <br /> owner of the property abutting thereon as right-of-way; and, <br /> WHEREAS, the public interest will be subserved by vacating said right-of-way and the <br /> public will be relieved from the further burden and responsibility of maintaining the same. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR, ILLINOIS: <br /> Section 1. That the above described right-of-way be, and the same is hereby, vacated <br /> inasmuch as the same is no longer required for public use and the public interest will be <br /> subserved by such vacation, said right-of-way being shown on the plat thereof hereto attached <br /> and hereby made a part hereof. <br /> Section 2.
