STAFF REPORT <br /> Decatur City Plan Commission <br /> COMMON NAME: Alleyway Vacation, 1200 Block of West Eldorado Street <br /> GENERAL INFORMATION <br /> Hearing Date September 3, 2009 <br /> Calendar No. 09-41 <br /> Property Location 1200 Blocks of West Eldorado Street <br /> Requested Action Vacate the 16 foot alleyway in the 1200 Block of West Eldorado <br /> Street <br /> Petitioner Cedarwood Development <br /> Representative Rick Dilsavor <br /> LAND USE AND ZONING <br /> Direction Existing Land Use Zoning Comprehensive Plan <br /> Subject Property Right-of-Way B-2 Commercial <br /> North Vacant/Right-of-Way B-2 Commercial, <br /> South Vacant B-2 Commercial <br /> East Right-of-Way B-2 Commercial <br /> West Right-of-Way R-3 Low Density Residential <br /> BACKGROUND <br /> 1. The petitioner is requesting vacating the 16 foot alleyway in the 1200 Block of West <br /> Eldorado Street. The alleyway is adjacent to the property the petitioner has a contract to <br /> purchase. The vacation will enable the petitioner to construct a CVS Pharmacy. <br /> STAFF ANALYSIS <br /> 1. Letters were sent to AmerenIP, Comcast Communications, and AT&T notifying the utility <br /> companies of the vacation request and no objections to the proposed right-of-way vacation <br /> were expressed. The Illinois Department of Transportation has submitted a letter to the <br /> City that it has no opposition to the vacation of the right-of-way. <br /> 2. An appraisal for the alleyway was submitted by the petitioner with an estimated market <br /> value of $17,000. A second appraisal was obtained by the City with an estimated market <br /> value of $9,500. The petitioner will pay the City of Decatur $13,250 for the alleyway <br /> vacation. <br /> 3. The formal vacation of this alleyway will not have an adverse affect on the general public. <br /> 4. The right-of-way is not necessary to serve the general public. Staff is of the opinion that the <br /> best interests of the City of Decatur would be served by approving the right-of-way <br /> vacation. <br />
