Excerpts from Plan Commission Minutes of August 6, 2009 <br /> Cal. No. 09-32 Petition of DENNIS D. BALLINGER to rezone <br /> from R-6 to PD Planned Development District at <br /> 1596 NORTH MAIN STREET to allow for a <br /> storage garage. <br /> Ms. Ashe was sworn in by Mrs. Althoff. <br /> Ms. Ashe presented the recommendation of staff: <br /> The subject site is located at 1596 North Main Street, contains approximately 7,080 square feet <br /> and currently houses a single family home with a detached garage. The petitioner owns many <br /> lots along this corridor and is proposing to use the garage as storage for lawn equipment for the <br /> maintenance of said lots. <br /> The petitioner proposes to rezone the parcel from R-6, Multiple Dwelling District to PD Planned <br /> Development in order to allow for a free standing garage to remain on the property once the <br /> main structure is demolished. The garage will be used for the storage of lawn equipment. <br /> The surrounding zoning includes R-6, Multiple Dwelling Districts and B-2, Commercial <br /> Districts. The Decatur Urban Area Land Use Plan shows this area as Commercial-Planned <br /> Development. The proposed use of a storage garage for lawn equipment is compatible with the <br /> adjacent uses of the surrounding area as many homes use their garages for lawn equipment <br /> storage. Maintaining this garage as well as the petitioners surrounding properties in the area will <br /> not have an adverse affect on the adjacent properties. The rezoning is compatible with the intent <br /> of the Comprehensive Plan and the Decatur Urban Area Land Use Plan. <br /> Staff recommends approval of the rezoning with the following condition: <br /> a. The Rezoning Ordinance will not be signed until the Demolition Permit for the main <br /> structure has been finalized. <br /> Section XIX.G.2. of the City of Decatur Zoning Ordinance requires the Plan Commission to hold <br /> a public hearing to review the PD plan and report its findings concerning the effect on the <br /> comprehensive plan and compliance with the standards of review to the City Council. A motion <br /> to forward Calendar Number 09-32 to the City Council with a recommendation for approval is <br /> suggested. <br /> Mr. Mickler asked whether there are any ramifications for tearing down the house and leaving <br /> the garage. <br /> Ms. Ashe stated that anything else done on the property will need to come before the Plan <br /> Commission to amend the PD. <br /> It was moved and seconded (Livingston/Sadorus) to forward Cal. No. 09-32 to the City Council <br /> with recommendation for approval as presented by staff. Motion carried unanimously. <br />
