Chapter 28 B. The Commission shall have the duty of making investigations in the field of human relations in accordance with the ordinances of the City of Decatur. In performing this function,the Commission shall cooperate with the Mayor,City Council,City Manager,departments and divisions of the City, or with any other appropriate governmental agencies. SECTION 3-7. The Commission shall at least annually report to the City Council its activities and recommendations. ARTICLE 4. HUMAN RIGHTS OFFICER. SECTION 4-1. There is hereby created the office of Human Rights Officer,the occupant whe- reof shall be appointed,and may be removed,by the City Manager at will. SECTION 4-2. The Human Rights Officer shall work under the supervision and control of the Human Resources Manager and shall have such duties and functions as are assigned by said Manager,in addition to such duties as are established by this Chapter. ARTICLE 5. INVESTIGATION AND CONCILIATION. SECTION 5-1. Any individual who believes that he or she has been unlawfully discriminated against may file a charge with the Human Rights Officer. Such charge must be filed within 180 days after the date that the human rights violation allegedly was committed. SECTION 5-2. Such charge shall be a written statement,under oath or affirmation, setting forth facts alleging that a human rights violation has occurred in a manner sufficient to enable the Human Rights Officer to identify the protected class of the complainant,the specific act of discrimination alleged, and the identity of the respondent. SECTION 5-3. Charges may be voluntarily withdrawn at the request of the complainant at any time prior to the completion of the public hearing specified in Article 6. SECTION 5-4. The Human Rights Officer shall promptly investigate allegations of discrimina- tion set forth in any charge,and make a determination in writing whether or not there is probable cause to believe that this Chapter has been violated and on what facts such violation is based.
