Ashe,Historic Preservation&Corridors Planner <br /> SUBJECT: Amend the B-3 Planned Shopping District to allow for a larger structure. <br /> SUMMARY RECOMMENDATION: Staff recommends approval of the amendment to the B-3 <br /> Planned Shopping District with the following conditions: <br /> a. Relocate south handicap parking space to be closest accessible space to the south door. <br /> b. Provide a curb or bumper blocks. <br /> c. Truncated domes should be placed where a sidewalk leads to a vehicular path of travel. <br /> d. Final site plans and construction plans shall be submitted to and approved by the Economic <br /> and Urban Development Department and the Department of Engineering and Infrastructure <br /> prior to the issuance of a building permit. <br /> The City Plan Commission voted 7-0 to recommend approval of this petition at the June 4, 2009 meeting; <br /> the minutes of the meeting are attached. <br /> BACKGROUND: The 1.14 acre subject site is currently vacant and is zoned B-3 Planned Shopping <br /> Center District and has been zoned as such since the 1960s. In 1998, it was amended to include more <br /> property to the north. In 2008, the previous building (Arby's fast food chain) was demolished. In April <br /> of 2009, the site was approved for the construction of a dual-use commercial/retail and restaurant/drive- <br /> thru facility. <br /> The subject petition requests that the B-3 be amended to allow for approximately five-hundred (500) <br /> more square feet for a total of 6,600 square feet as potential tenants have requested larger space. The <br /> originally approved parking and landscaping will remain and will still meet the requirements of the <br /> Zoning Ordinance even with the additional square footage. <br /> The proposed amendment to the B-3 is consistent with the character of the surrounding neighborhood and <br /> general area. The B-3 is consistent with the intent of the original B-3 and the Comprehensive Plan. <br /> POTENTIAL OBJECTION: While there were no objectors present, questions about potential effects <br /> on the drainage were brought forth by a concerned citizen. <br /> INPUT FROM OTHER SOURCES: The Conditional Use Permit has been reviewed by the City's <br /> Technical Review Committee; Planning, Engineering and Fire have approved the proposed plan. <br /> STAFF REFERENCE: Any additional questions may be forwarded to Stephanie E.
