Excerpts from Plan Commission Minutes of May 7,2009 continued:
needs a consultation concerning their fence the inspectors would go to their property to help
them. His staff will not identify their property lines.
Mr. Jackson asked Mr. Johner how many calls he gets concerning fences. Mr. Johner responded
he gets approximately between twenty-five (25)to fifty (50) calls per season.
Chairman Smith asked if this change would include retaining walls. Mr. Johner stated it would
not.
Mr. Robert Maulding was sworn in by Mrs. Poland.
Mr. Maulding stated he lives at 742 West Forest Street. His property backs up to a thirty (30)
unit apartment building and he has a six (6) foot privacy fence across his back yard. Mr.
Maulding says without his fence his property would not be tolerable. He stated people need to
move into the inner city neighborhoods and he feels if people are forced to get a permit to install
a fence they will decide not to move in. Mr. Maulding stated the property pins on the inner city
properties are almost impossible to find. He does not feel the changes in the Ordinance will
eliminate the few problems the City is having with people building fences on their neighbor's
property.
Mr. Maulding said this matter was brought up at a recent CONO meeting and it was not well
received.
Mr. Maulding does not believe citizens need someone telling them which side of a fence needs to
face the inside or outside of their property.
Mr. Jackson is concerned the fee of twenty-five dollars ($25.00) is too high. Mr. Anderson said
if you are planning on putting up a fence a twenty-five dollar ($25.00) permit fee would not be
the deciding factor.
It was moved and seconded (Anderson/Mickler) to forward Cal. No. 09-24 to the City Council
with recommendation for approval as presented by staff. Motion carried 6-0-1 with Elayna
Sadorus abstaining from the vote.
